In August of 2020 I contracted with Justis Lund DBA Sick Coatz, 100 Main Street of Tea, SD to sand…read moreblast and powder coat my white balcony railing for my condominium at Country Club Estates since it had some small amounts of rust coming through the finish. After the railing was returned by Sick Coatz my contractor came to re-install it and brought to my attention that the railing had large 2-4 inch areas where there was bare metal showing and my contractor informed me that because of this fact the entire railing needed to be re-sand blasted and re-powder coated. Since I had already written Sick Coatz a $725 check for their work I found it necessary to call my bank and pay a stop payment fee on the check. Justis Lund came and retrieved my balcony railing and agreed to make a second attempt and start over. The railing was re-delivered to me after that second attempt in late November of 2020, paid for a second time and since it looked great at that point it was re-installed right after Thanksgiving in 2020. Three months later, on February 23rd of 2021 I went outside onto my balcony to discover that my entire 12 foot long white balcony railing was covered in a fine layer of rust. I immediately contacted Justis Lund by text message and attached multiple photos of the rust. Justis Lund showed no concern over the state of my railing. He didn't come to look at it. He didn't offer any solutions. For the next several months the state of my balcony railing deteriorated and I attempted to work out a resolution with Justis Lund by text messages but was unable to get any concern from him over the situation. Finally on April 20th, 2021 I sent Justis Lund a letter saying that since he had offered no resolution that I was requesting a refund of the $725 that I had paid him so that we could both move on. I received no reply. I texted Justis Lund again and asked what his intentions were and received a text message that said " I am blown away that you think that I owe you anything. Your balcony railing was old". I realized that it was time to escalate my financial loss to a small claims case and did so. On June 6th, 2021 before the small claims case was heard in court I received a formal letter from the Country Club Estates Homeowners Association giving me warning that I had until October 31st of 2021 to remedy that rust on my railing or face fines. I then found it necessary to have the railing completely re-sand blasted and re-powder coated by another company and since it was now about 100 times worse than it had been originally it cost me $1000 to have it done over. That was in August of 2021 and I am writing this on September 2nd, 2022 and I can tell you that a year later my balcony railing is still as beautiful as the day that it was re-installed a year ago now that it has been done properly. On August 4th, 2021 my small claims case against Sock Coatz was heard but Justis Lund failed to show up in court. I received a judgment of $957.79 against him. He had 30 days to pay me and he made no attempt to do so so I hired the Lincoln Country Sheriffs Deputy to execute the judgment for additional fees of $238.25 but to this day I have received no monies from Justis Lund. At this point I am owed a total of $1196.04 for the judgment and additional fees from Justis Lund plus accrued interest. If you care to verify the truthfulness of what I am claiming here please call the Minnehaha County Clerk of Court Office at 605-367-5900 and reference docket #49SMC21-002921-01. Remember, if Justis Lund at Sick Caotz treated me this way he will probably treat you the same so BEWARE! Mona A Sinkey Sioux Falls, SD
