I should have known by his wet noodle handshake with no eye contact whatsoever. Michael Collins, my lawyer at Cain and Herren, was not trustworthy. Michael, who looks to have just graduated high school, made over 30 mistakes on my case. BAD mistakes. But much worse than that, he chronically over-billed me for 2 years, to the tune of many, many thousands of dollars. (3 hours billed to type a paragraph? Really?) When it finally became to much to bear, I asked to do a thorough accounting of my billing. I was told that everyone just went home sick and no one could talk to me. The next day they withdrew as my attorneys. I talked to Michael and he ADMITTED he had over-billed me $10k+, and I RECORDED IT! Here is some transcript from our trial. (ME) Q. "And what did you say when I accused you?" (MICHAEL COLLINS) A. "I said, Jason, I'm willing to admit that some of the billing may have been overbilling, but I expected you to pay it." OVERBILLING IS STEALING. Micheal was awful to deal with. He is condescending and smug and completely lacks integrity. I called David Cain FOUR separate times, to discuss the chronic over-billing and mistakes. He never returned my call. Not once. These low-lifes have the nerve to call themselves "The Lawyers with Heart'" More appropriate would be "The rat-bastard lawyers that make you realize why people hate lawyers!" UPDATE: Apparently Michael Collins has been disbarred "The court found "sufficient evidence in the record to demonstrate that Collins has committed multiple violations of the Hawaii Rules of Professional Conduct and poses a substantial threat of serious harm to the public," according to a news release from the Office of Disciplinary Counsel." read more

I wouldn't leave even one star but it doesn't let you pick "no stars". I wish I looked at the reviews first. Poor representation and the communication was even worse. They didn't even do discovery or any process to prove anything in my case which really left me in a bad situation in the end. I got nothing at all from the entire process and at the end of 2 years I was told to settle bc I wouldn't win anything. My attorney never returned emails or even looked at them at that matter. The paralegal made numerous mistakes that i had to correct. The only time i got call backs was when i owed them money. PLEASE find someone else....if my review can help one person not have this representation then it was well worth it. It's unfortunate I stayed with them till the end as I trusted they cared like their logo says they do. It's sad that you put your trust and a lot of money in these people and they literally had no interest at all in my matter at all. I came out worse than I went in with...Multiple people have said to me the same exact thing once they hear who represented me, so I know it's not only my case that was poorly and unprofessionally handled. Their dedication to my case was poor, the communication was far worse. The professionalism was amiss, they merely reacted to the opposing attorney's moves, we were never proactive in what should have been our actions. Five months in, with $12,000+ invested they informed me I should settle, for a judge would likely not rule in my favor. This was not the pretense we started the case under, for at the onset I was informed that I "had a strong case", and nothing changed during that time. I feel they merely took the case for money and strung me along with little to no hope of ever getting the result I was originally optimistic about. I would not recommend C&H to anyone. read more

As per a local attorney volunteering and doing for the people what most would not do, the great majority of his colleagues in Maui are "either greedy, lazy or selfish" Cain & Herren count as the most greedy and, unfortunately, spreading like cancer through the junior attorneys they school in their ways to then go open their little office and get the crumbs off C&H's table (clients as thirsty for blood and unrighteousness in the courts but with less $ power to afford the big firm), and that is all they are bigger than the other firms, not good, not honoring of Hawaii and Aloha, and definitely not respectable. read more

i have never had more incompetent lawyer in my life. Michael Collins filed a a defamation case for me in small claims court. Well he did not know you can not do that cause small claims court do not do defamation law s cases. Yet he still charged me for the filling. I had to inform him that we we missed our trial date that he was unaware of causing our case to get dismissed while the defendant lawyers filed a SLAPP suite against us of course Michael said it was laughable the slap case and yet still Michael offered the defendant $4000 to settle by paying the defendants lawyer's attorneys fees and defendant because he mess up. I asked for them to return some of my money because of the incompetency of filing incorrect claims and not filing for a hearing and a TRO that they agreed-upon and yet they filed it as a non-hearing. The communication was completely annoying with Michael and many times did not get phone calls back from him. I would not recommend him anyone at any time the worst experience I've ever had. -I ended up spending money on them and actually leaving and having to give up my TRO on this because of their incompetency. on top of that I just found out that they settled out of court without informing me of the settlement which I did not agree to I will be filing a formal complaint against them. they misrepresented me and lied to me knowingly and willingly. we shall see what happens with my complaint. read more

It is very difficult to contact anyone besides the receptionist. They knew the law, but were ill prepared,; sometimes reviewing our case just before the hearing. Every email contact is a minimum of $15, regardless of the content. We got to the point where we would ask many questions at once, hoping to save some money. I thought we said something to offend them because they didn't return calls after judgment, but the receptionist said, "No, you are great clients. They will call by tomorrow. " Then there would be no call or email. I ended up contacting the court directly to try and get documents. read more

Well, what goes up, must come down! As it turns out Cain and Herren LLLP is somewhat hostile to mortgage foreclosure defense. When I asked them to describe the time frame involved with respect to the stay on foreclosure associated with the bankruptcy they told me that they would be unwilling to do any work in stopping the banks from lifting the automatic stay created by the bankruptcy. When I asked them to explain this position one of their attorneys informed me that mortgage foreclosure defense is baseless and that they will not jeopardize their relationship with a particular judge by filing such a motion. I find this to be extremely unethical and therefore I have retained a different law firm to represent me. Cain and Herren is fired. I am giving them a 2 star review for refunding a portion of my money, otherwise it would be a 1 star review. read more

I spent a small fortune (to me) with this law firm and could not be more satisfied with their service and results! Ben Herren is an outstanding divorce attorney and he has the most talented and wonderful assistants you could ever ask for. While their response to my questions were not always as fast as I would have liked, I soon realized and understood that because they are one of the best, they are extremely busy. However, I can say that any time I had a critical issue, (and there were many) they responded immediately and were very sensitive to my needs. Mr. Herren achieved the best outcome possible for me in my "high conflict" case and he actually went FAR above and beyond what I was charged for.
