My father had me help him find this process server for a small claims case his company has since I am a law student and more familiar with the process. I will not mention the name of my school because I am afraid due to Kyle's threats against me. At first, Kyle sounded professional and said that he was having trouble serving the defendant, and on March 3rd told me that he mailed the service to the Secretary of State since the defendant seemed to not be at the house to be served. A few weeks later, the defendant gave Kyle a call and since then things switched up. The defendant racially profiled my dad as an African American man and scammed him of his money. I believe that after Kyle spoke to the defendant on the phone, the defendant convinced Kyle to work against my dad due to racial profiling and Kyle then agreed to collude with the defendant and self-help him by not filing the documents to the Secretary of State and he claimed he did and as he is supposed to, so that the defendant can be held responsible and pay back the money he stole from my dad, which is about $10,000. Last week, Kyle told me he was still unable to serve the defendant at home, but with the COVID-19 stay at home order, the defendant should be at home. Kyle then sent my dad an invoice for payment refusing to give proof of service to the Secretary of State. My dad had no problem paying Kyle's payment of $140 total, but he refused to cooperate and give us some form of proof he actually sent the service to the Secretary of State. Since we suspected that Kyle has colluded with the defendant, we told him we did not feel comfortable paying him without some sort of proof that he actually sent the mail. Part of our suspicion of his collusion was that after Kyle spoke to the defendant, he stopped answering my calls and did not reply to any of my follow up text messages or questions I had about the status of what he was doing for us. Kyle then became hostile, totally unprofessional and started threatening that if he doesn't get a payment immediately without proving to us that he sent the documents on march 3rd as he claimed, he is going to write to the court and even make himself available for the court hearing to help the defendant get away with my dad's stolen money. He then started questioning how my dad conducts his business, when he doesn't even know my dad nor did he put it into consideration that my dad is the victim in the case. My dad kept telling him that he would be happy to pay him and even requested for them to have a call this morning, since they have never spoken before, to discuss and resolve the issue and make sure that they are on the same page before paying him. Kyle refused and kept on threatening me and my dad via text messages, showing his intentions that he is only out to help the defendant get away with my father's stolen money without being held responsible by the law, which is what we have been suspecting. He kept on threatening my dad like my dad did anything wrong. This shows his mindset. If he actually sent the documents to the Secretary of State on march 3rd on my dad's behalf or did not collude with the defendant, then he would have had no issue showing me proof of mailing, at the very least, to get paid, so my dad could feel confident paying him his money. Instead, he escalated the treats. I advise anyone reading this/ the public to never hire this man. The owner of this company goes out and serves papers and uses other Process servers License # in case there's a screw up then the process server who license he used gets in trouble ! He does not pay his contractors and I believe he is on the sex offenders texas data base and uses a PO bOX witch is totally against the law and is a violation . read more
