Here is how BAIL BONDS work in New York State
ITS NOT 10%... THATS IN THE MOVIES (AND NEW JERSEY)!
ACTUALLY, IT'S LESS THAN 10% (On Average Premium is 6%)
In NYS there is PREMIUM and COLLATERAL
Premium = Cost of the bond (Not Refundable)
Collateral = Financial Security on the bond (Cash, Real Property, Vehicles/Boats)
(Collateral gets returned as long as the person bonded out makes all
appearances and does not incur any enforcement fees)
So here is an example - lets say that a Judge sets bail at $10,000.00 over $5,000.00
That means: $ 10,000 bail bond or $5,000 cash (at the jail window)
So, If you have $5,000.00 cash, you can go to the jail (or the court clerk) and pay them the
cash. When the case is over, they will keep 2% (regardless of guilt or innocence) and in this
case refund you $4,900.00. If the person on bond fails to appear for any reason
whatsoever, you LOOSE 100% OF YOUR MONEY
To get a $10,000.00 Bail Bond you need the following:
$860.00 Premium (The NYS set fee for a 10K Bond)
$1000.00 Cash Collateral -OR- A Homeowner (Signature) -OR- Vehicle Title(s)*
*The Book Value of the vehicle(s) must equal the amount of the bond
The person writing the bond (Indemnitor) must be 18+ years old, with ID, and
must be legally employed
When the case is over or when the Judge decides, the Bond will be Exonerated (finished)
A Certificate of Disposition MUST be obtained from the Court Clerk's Window and brought
to the Bail Bond Office.
As long as all appearances were made and no forfeitures occurred, the Indemnitor will receive a CHECK for any Cash Collateral. If Real Property or Vehicle Titles were used, a Lien Release will be issued to the Indemnitor.
