I would not recommend this company to represent your company or brand. I have received multiple text messages from John Vazquez , I have never opted into his mailing list, worked with him, or ever spoken to him in the past. This is a violation of the TCPA. If you are a business owner and hire a company like this, they could possibly market your brand using illegal (or fringe) marketing tactics, as that is how they market their own company.
As an advertising agency, one would expect them to know the laws around SMS marketing.
Not only is the message very deceiving, as the sender intended the message to appear like it was coming from a prospective client, or from someone I already knew. The overall approach is very misleading, tacky, annoying, and illegal.
These are basics in the advertising industry and all advertising firms should know these laws inside and out as they are representing their client's businesses.
Receiving an SMS like this from an ad agency founder is more than disturbing.
The law is very clear that even if you hire a company to handle your SMS marketing, you can't contract away your legal responsibility to comply with the law. Both the company whose product is being promoted in the message and the company that actually sends the message may be held legally responsible.
This is how they market their own agency; it pains me to think how they would market your company. If I was a business owner being represented by this company, I would not sleep at night. read more
