Later I learned that "non-refundable" retainers are impermissible under New York State law. Mr. Berg was admonished by the grievance committee for having me sign a "non-refundable" retainer. I wound up doing all of the estate work myself and I contacted Mr. Berg for a refund. He didn't respond to my initial request or several subsequent requests. As a result I had to sue him in small claims court where he admitted that he did owe me money and I was awarded a judgement against him. I have no opinion to his legal abilities but he is a terrible communicator.
