The next day I reached out to UPS about her injuries, they threatened her, and then fired her because of her injury. I had to call the police to have it reported what happened for future. And I kept the audio from her old supervisor. I mean he was mean, and really threatened her. I contacted a lawyer since they refused her medical care and her medicaid refused to pay for workers comp injuries. I was referred to this lawfirm. At first, Mr. Jesuele did a good job getting her to medical care, and liberty mutual barely complied. After everything my mother was referred to physical therapy that she never received because the insurance doesn't want to cover it, and medicaid refuse to cover anything relating to work accident. This case is going on 3 years, and many times I ask Mr. Jesuele to go to trial as that is what my mother wants, he refuse to. He is just pushing for her to just accept what he is telling her. 1. First offer he gave my mom was an offer that he said initially was a ball park that he and the other lawyer would talk about. But apparently he had already talked and decided on $11K. 2. After refusal, he went to get medicaid liens and never got back to me for months. Finally, I reached out, contacted medical liens office myself, and then something happened. Then we had a different offer, and my mom asked for a trial. He keep saying that is not advisable. Okay, so we ask for a better offer, and he said he would talk to the other lawyer. Never did. He communicates every once or twice a year. 3x time we asked to just go to trial, and he keeps pushing the case under, not doing anything about it. 3. This last thing pissed me off was today. He said the courts were closed last year, and he said the same to me today when we asked for trial. So my mom's case might be heard later this year or next year. Called the court. Everything is being done virtually, including trials. He never intended to do anything with my mom's case. I have a deep feeling he is acting in his and #libertymutual best interests. Not my moms. The big problem is my mom doesn't speak English and I personally have no time to deeply help her. But I have great feeling that because of that he is not acting in my mom's best interests. Already had settled with the other party. Last year, when asked for a trial, he acted like he would rather quit the case, and I was fine with that. But then said no thats not what he said. I feel like this is something to be investigating, and I should be filing a complaint with the state about this. This smells fishy like a malpractice situation. When people don't speak English or are not able to advocate for themselves, others take advantage. But if this continues, I will file a malpractice lawsuit. My mom doesn't speak English well, and she is limited to the jobs she can have. On top of that, her legs are impacted, her sleep, and she continues with pain. She cannot work her usual job because of this injury, but they are sitting there happy not to give her medical care, attention, and to have her settle for pennies that will be gone in months after she pays for her own phtaysical therapy and other care relating to this accident. What type of lawyer takes advantage of someone who already is at a disadvantage and is now partially dissable, and cannot even earn a keep.

I do want to share a particularly discomforting experience I had with the firm. Let me preface this with an observation that legal Intakes can be hit or miss. I Spoke to a lady there for about a minute who did not give her name or title, e.g. sounded like a secretary. She Was extremely rude, rushed and rejected a potential case as if too busy with other matters on her desk to take on a new case. It definitely did not sound like an attorney which was unusual for this firm to reject a case before attorney consideration. That is fine - if you have too much going on and are over-loaded with cases, it makes sense to reject a new case. I wouldn't want it any other way. But at least discuss the reasons therefore and give a referral to another qualified attorney who may be knowledgeable in the type of injury involved. To be fair, there are other intake attorneys there who are quite good which is why I refer to Rosemarie first. It was just the luck of the draw that this secretary happened to answer the phone and gave such a superficial rejection of a case I referred to them as a courtesy because of the positive experiences I had with their attorneys in the past. I'll give them another chance in the future, but my experience does confirm the experience of another opinion - writer, Lynda H. (8/25/23) albeit this is a one-off experience for me. I was referred to Jaroslawicz and Jaros by a doctor, who may have been paid to refer me…read more My case was grossly mishandled and the lawyers appointed to handle it, did not read any of my charts or ask for updated information on the status of my health or anything else that might be slightly relevant to the case. If you hire them, you may very well be throwing out a reasonable case. Moreover, David Jaroslawicz signed an agreement before uploading documents to e-courts (NYC's online, public database) that clearly stated that none of the documents contained personal information. Of course, in line with their careful and attentive nature, they uploaded my social security number, address, phone number and date of birth all on one document. Do you know how I know that? Because someone I know looked up my name and found ALL of that information, then left me a frantic voicemail. Admittedly, I had been advised that the firm's namesake was (verbatim) "a slimy guy," by another lawyer who had previously worked with them, but then again, I was so used to receiving no helpful legal advice from lawyers, that I suppose my ignorance to it was to be expected. One caveat at my settlement talk was apparently that I had [at the advice of my lawyer, Ms. Younie Choi] deleted facebook before my deposition. I am not sure how they managed to hold their own legal advice against me, but I was berated in a random, quiet part of the office by an associate of the firm, as Ms. Choi quietly watched me take crap for her advice, while I tried not to implicate her or throw her under the bus for her advice, the way she had done to me for listening to it. The second damnable piece of evidence was that I used my first and middle name, as I feel uncomfortable displaying my, "real," [last] name on facebook [such has been the case for a very long time]. A third problem was that I used a front facing camera on my Macbook, which took a mirror image photo, this is of course entirely verifiable with 0 margin for error (don't you love technology and law firms relevant enough to know how to use it?), but in their own words, they, "would not be able to convince a jury." They gave me an option to find another lawyer after the settlement hearing. (Around Christmas and New Year's) and they threatened to withdraw from the case if I opted to pursue it, rather than to settle. At the end of the day, the amount of stress, anxiety, aggravation and debt that I acquired when I opted for this firm, made it completely not worth the settlement (which was not enough cover my debts or my medical treatment going forward). The amount of sheer incompetence was unparalleled. The fact that they somehow manage to balance that prodigious volume of incompetence, carelessness and a complete lack of accountability, is really the most impressive thing about this firm. In this respect, they are excellent at multi-tasking These guys are excellent for fat people who sue McDonald's, women who sue athletes and people who allege that their herpes came from Sephora. If you have a real injury, get a real law firm. If you hire these guys, you'll get a novelty firm. It is the intellectual equivalent of taking a cap gun to the OK Corral. That's my take, anyway. I wonder how long it's gonna take before they try to get my take taken down. (Feel free to google "David Jaroslwicz" and see what the NY Times/NY Daily News, etc. have to say about him.
