Live Painting C.

Live Painting received a letter no the 8th of January of 2018. The letter consisted of a Lawsuit against us. The letter claimed that Live Painting did not install drywall correctly. Mario and Ebony Reylonds were pursuing us to us two options. option one was to redo the job. or pay them $4,000 to hire another contractor. The Reylonds bought all the materials that were needed for the job. We have a signed contract stating that the material bought by the owners were not recommend by Live Painting. We let the owners know that we would not be giving out warranty on the project because the material that was bought was not correct. The Reylonds decided to put bad reviews all over our platforms with false information. Due to the false reviews we lost traffic in work. We started to loose money because people were seeing this false accusations After the Reynolds decided to hire Sally Lee McClellan to processed with a lawsuit. In the letter that Live Painting received. We had 7 days to tender cashier a check to the owners. after 7 days nothing had happened. We stood by our contracts we had and all the proof we needed that we were not at fault. Later after nothing had happened we thought it was fishy that we were never contacted again by Sally. So we decided to investigate ourselves and we came in contact with Sally and we found out that the lawsuit was fake and it was a tactic to scare us into paying the owners to hire a new contractor. We contacted Sally because Live Painting was really to file a counter Lawsuit due to the fact we were loosing clients because of the false reviews. Sally stated that she was just a friend of the Reylonds and she was asked to make a fake lawsuit as a favor. She did not want to get into the counter lawsuit we were ready to file. Sally Lee McClellan abused o her title of being a licensed lawyer. We are very disappointed that the Owners and Sally went this far to make false accusations. They tried threatening us into giving them money or free workmanship. Trying scare us with childish tactics. VERY UNPROFESSIONAL. ALL THOSE YEARS OF STUDDING TO RECEIVE LAWYER LICENSE TO HELP PEOPLE. FOR SALLY AND HER TEAM TO TRY TO MAKE FALSE LAWSUIT AND ABUSE HER TITLE AS A LAWYER. TODAY IS 07/03/19 NOTHING HAS HAPPENED WITH THIS FAKE LAWSUIT. read more

Recently, I found myself involved in a legal matter that was both emotionally and financially draining. My ex- husband falsely accused me of harming my daughter and filed a claim against me with DCFS for child abuse, additionally he filed an emergency motion to modify parental time. Initially, I was advised by one of her associates to agree with OC suggestion by appointing a Guardian ad Litem to proceed with investigation, which I did openly agreed because I had nothing to hide and I wanted to uncover the truth about a difficult situation involving my daughter and how things really transpired. During this process, I was following my case very closely and during my research on previous judgements I discovered inconsistencies that were done in my previous judgment that was handled by another former attorney at the time; so I uncovered new evidence that my ex-husband had not complied with court orders as it was expected at the time, he failed to comply with certain financial obligations specifically from the mandated order. I shared all of these information and provided documentation to prove my statements, I confided all to Monika to bring justice after my daughter's case was properly handled and done to then pursue instructed legal remedies; she was supposed to proceed with the other two specific motions to enforce payment obligations and a motion to vacate last judgement, I even provided the IL civil code and specific statute and subsection with case law samples to serve her that will allow to move the case aside and ask for relief in a form of back payments, initially she stated that we need to filed right away and afterward she stated I did not have basis for it. I disagreed because I clearly show her proof of misapplication of the law based on my allocation judgement and court calculation sheet, I provided newly discovered evidence, and post divorce fraud, etc. I never thought that Monika would be another average attorney that acquired the typical business pattern as others. However, I was disappointed with the way my case was handled. Monika's responses to the OC emergency motion to modify parental time were very generic, often simply denying allegations and requesting proof, despite having provided statements and evidence that supported my position Strongly. For example, my case included the fact that the DCFS investigation determine the accusations against me to be unfounded--information that could have strengthened my case and demonstrated my innocence. I believed it was crucial to include this and other vital facts, such as my role as guardian of my children, but Monika was hesitant, claiming it could harm my case. I strongly disagreed, as I believe transparency and honesty are essential in such situations. To my surprise, Monika filed a motion to withdraw from representing me, stating "irreconcilable differences" which is totally not true, my total bill exceeded $8,000--costs accumulated primarily through email exchanges /communications and the preparation of motions that were never filed But were detailed in my invoice . While I acknowledge her legal experience or trajectory, I felt she did not prioritize my best interests or those of my children. As a client, I believe it's essential to be actively involved and to have control over our own case, providing clear instructions and understanding your rights. This experience has reinforced my belief that the legal system in the U.S. can be complex and must of the time flawed. Some attorneys may prioritize their fees, their business and their colleagues relationships over clients' best interests, and their children; unfortunately, there can be a lack of accountability within the system. Clients need to be proactive--know your rights, ask questions, and take an active role in your case. Be your own advocate, conduct your own research, and ensure your legal representation aligns with your goals. My advice to anyone facing legal issues is to set clear expectations from the beginning, stay involved, and remember that ultimately, you are the owner of your case, you are paying for legal representation and you are in charge of your case, the attorney is there to advise and advocate for the best action to take and explain your options not seeing you as $ sign. We are talking about real people, real children involved in family matter and yet seem like there isn't much to care for but money coming in. Do not rely solely on your attorney; be informed and assertive. The legal process can be challenging, but being proactive can help protect your rights and interests. Aquarius.... When you need someone to have your back.. you get a brawler…read more It's a Sunday morning, we answer the door and a perfectly good day in May 2014 is tainted by the foul, fetid stench of the beast on my stoop... Mr. Woodbury? It asks.. "Yes", I say. "you've been served" What the...? I had neglected to immediately inform a homeowners association of my change of address, I rectified it (acknowledged in writing in 2013 by the association) but they never made the change someplace. They raised our fees $20 a month, but because we didn't know, we happily kept autopaying monthly thinking that "all is right with the world" We were less than $300 in the hole and a phone call, letter.... email (same email since 1998) would have taken care of it. Instead, satan's spawn (just kidding, he was just a regular guy) showed up with a summons saying that they had amassed a lot of costs trying to get this money from me... just about $3,000 worth of attorney and late fees. This was the first that I'd heard about it. My regular Attorney couldn't get anywhere with them, they told him that if we go to court the costs will keep going up. Well, he's no dummy and he knows this situation makes no sense* so he tries to reason with them (he's doing this as a favor, it's not his kind of law) but they ignore him. We make an offer to settle... because I know that I owe and that there will be late fees. They tell us.. "See you in court" So I tell my friend that I think I need to get a guy that specializes in this kind of stuff.. a tough guy.. a LITIGATOR. *it actually makes perfect sense now, it appears that the association has something against landlords (I've had the same great tenant for the last 5 years) and are making things harder for us. I work with a lot of Attorneys, but most of them do family law, traffic court, real estate etc.. I saw Dave in the courtroom when I was setting up my trial date, he was representing a Plaintiff. We talked briefly in the hallway. Dave and I scheduled an hour to go over the case in his office. We met, and he informed me that I have an excellent case and that I should consider putting a very short time limit on the settlement offer that I had made the association.. so I did, and... They ignored me. Dave became my attorney, filed our appearances for court and sent a copy to the opposing counsel. Suddenly, the other side wanted to negotiate and came back with an offer. Now I have costs, so we told them "no". We made a low ball offer back... and they said "See you in court". We said OK. They asked what it was going to take... Dave told them... The F bombs were flying from the other side :) They settled for far less than I had offered them the week before. I was able to pay Dave Clark and the association and still have enough money left to take the family to Gibsons for a steak dinner over what I would have paid in my previous offer (wish I had called Dave sooner) Dave thinks we would have had even more success in court, but the settlement was close enough. A trial (however short and easy) is a bunch of aggravation that I prefer to avoid. A couple of things.. When we first talked I was thinking that my case was too small for Dave, he's participated in some pretty large cases. But i never felt that way. Outside of the courtroom, Dave is a nice guy. After our meeting I was confident that I had the right Attorney. He's comfortable in his own skin, patient, competitive (The dude has run a marathon in all 50 states... seriously, who does that?) and is able to argue facts appropriately. Hopefully, we never need him for personal injury problems, but I'm glad to have a guy that does Business and Contract Law as well as Landlord/Tenant stuff.
