Police Investigating Me: Do I Need a Lawyer? - Pre-Filing Investigations and the Imperative of Early Legal Counsel In the realm of criminal justice, the period preceding the formal filing of charges, often characterized by pre-filing investigations (PFIs), presents a critical juncture for individuals potentially implicated in criminal activity. This pre-charge phase, while seemingly less formal than post-indictment proceedings, is rife with complexities and potential pitfalls that underscore the vital importance of early legal intervention. This commentary will explore the nature of PFIs, highlighting the strategic advantages of securing legal counsel prior to the initiation of formal charges. PFIs generally manifest in two distinct forms. The first type originates at the scene of an alleged incident, often continuing into custodial settings. Law enforcement, while ostensibly engaged in information gathering, may employ subtle tactics designed to elicit incriminating statements. The seemingly innocuous nature of on-scene questioning, often framed as a mere attempt to "find out what happened," can be deceptively perilous. Furthermore, the ubiquity of recording technologies within correctional facilities necessitates a heightened awareness of the potential for self-incrimination during ostensibly private communications, including legally mandated free phone calls. A particularly nuanced scenario arises when an individual appears for an arraignment date indicated on a citation only to discover that charges have yet to be formally filed. This temporal gap, bounded by the applicable statute of limitations, allows law enforcement to continue its investigation, potentially culminating in the subsequent issuance of a warrant. During this period, informal contact by law enforcement, including requests for interviews or even unannounced visits to one's residence, can pose significant risks. The second type of PFI involves pre-filing diversion (PFD) programs. In these instances, the prosecutor may extend an "offer" to the individual contingent upon the completion of specific prerequisites, such as community service or educational programs. While seemingly advantageous, PFDs present their own set of challenges. The terms of such agreements can be intricate, and, crucially, the prosecutor retains discretion regarding the ultimate decision to file charges. This lack of binding commitment underscores the necessity of legal counsel to navigate the complexities of PFD negotiations and ensure the protection of the individual's rights. The presence of an attorney during meetings or communications with the prosecutor, while allowing the client to be present, ensures that no potentially incriminating statements are made. In both PFI scenarios, the proactive involvement of legal counsel is paramount. An attorney can advise individuals of their constitutional rights, including the Fifth Amendment privilege against self-incrimination and the Sixth Amendment right to 1 counsel. Critically, an attorney can conduct independent inquiries to ascertain the existence of outstanding warrants or other potential legal risks, often without directly contacting law enforcement. This proactive approach can significantly mitigate the potential for unforeseen legal consequences. Moreover, in situations where a warrant has been issued, legal counsel can facilitate a negotiated surrender, potentially positioning the individual more favorably before the court. This demonstration of cooperation can be a crucial factor in judicial determinations regarding release on recognizance or the setting of bail. The strategic value of early legal intervention cannot be overstated. By engaging counsel during the PFI stage, individuals can safeguard their rights, navigate the intricacies of pre-charge proceedings, and potentially avoid the filing of formal charges altogether. The decision to consult with an attorney should not be deferred until charges are filed; rather, it should be a proactive step taken at the earliest indication of a potential criminal investigation. Federal Detention Hearings - Federal detention hearings, while analogous to state arraignment hearings in their purpose, are governed by the specific provisions of 18 U.S.C. § 3142. This statute provides the framework for judicial determinations regarding pretrial release or detention in federal criminal cases, and its intricacies are essential knowledge for effective advocacy in this context. This commentary will analyze the procedural aspects of these hearings, emphasizing the critical role of timely preparation and post-hearing documentation. Section 3142 delineates four possible outcomes following a detention hearing: (1) release on personal recognizance or unsecured appearance bond; (2) release subject to conditions; (3) temporary detention pending revocation of conditional release, deportation, or exclusion; and (4) detention. The magistrate judge's decision hinges on an evaluation of several enumerated factors: (1) the nature and circumstances of the offense, including whether it is a crime of violence, a violation of 18 U.S.C. § 1591, a federal crime of terrorism, or involves a minor victim or a controlled substance, firearm, explosive, or destructive device; (2) the weight of the evidence against the person; (3) the history and characteristics of the person, including character, physical and mental condition, family ties, employment, financial resources, length of residence, community ties, past conduct, substance abuse history, criminal history, and record of court appearances, as well as the person's status on probation, parole, or other release at the time of the offense; and (4) the nature and seriousness of the danger posed by the person's release. Regarding financial conditions of release, the judicial officer may, and upon government motion shall, inquire into the source of property offered for forfeiture or as collateral, declining to accept property whose source casts doubt on its suitability to assure appearance. The detention hearing itself is a time-sensitive proceeding. While generally scheduled within 72 hours or five days with a showing of good cause for the defendant, the hearing can occur even more rapidly. This compressed timeframe underscores the imperative for swift action by defense counsel, family, and friends to gather pertinent information and prepare for the hearing. The cited reference to the Justice Manual further emphasizes the importance of adhering to these temporal constraints. Even after the hearing concludes, regardless of the magistrate judge's decision, significant procedural steps remain. If release is granted, a bond package must be meticulously assembled, often involving contributions from family and friends. Bail conditions may include requirements such as payment by a U.S. citizen with verifiable employment, a cash deposit, or the pledging of collateral like real property. Securing documentation such as property deeds can be time-consuming, necessitating proactive efforts. Critically, the bond package requires approval from the Assistant United States Attorney, a departure from state court practice. This prosecutorial oversight adds another layer of complexity to the process. Only upon the AUSA's consent will the judge typically approve the bond package and order the client's release from the detention facility. This intricate sequence of events highlights the procedural hurdles inherent in securing pretrial release in the federal system. By Geronimo Gutierrez IV, Chief Counsel, 02/15/2025

Understanding Bail and Bond: How to Get Released from Jail - Being arrested and taken into custody can be a frightening experience. One of the most immediate concerns is getting released from jail. This is where bail and bond come into play. While the terms are often used interchangeably, they have distinct meanings. This blog post will demystify the process, explain the differences, and provide practical information on how to secure your release. What is Bail? Bail is the amount of money a court sets as a condition for your release from jail. It can also be issued by the jail you are sent to before you even see a judge. Commonly, the bail set at the jail can be much higher than what a judge would set at your arraignment, which may also include avoiding bail altogether by having you promise that you or your attorney will appear at every court date. Bail is essentially a guarantee that you will appear in court for your scheduled hearings. The amount of bail is determined by various factors, including: The severity of the alleged crime Your criminal history Your ties to the community Your flight risk What is a Bond? A bond is a financial guarantee, often provided by a bail bondsman, that ensures your appearance in court. Instead of paying the full bail amount directly to the court, you pay a non-refundable percentage (typically 10%) to a bail bondsman, who then posts the full bail amount. The Difference Between Bail and Bond: Bail: The total amount of money set by the court. Bond: The financial agreement with a bail bondsman to secure your release. How Does the Process Work? Arrest and Booking: After an arrest, you'll be booked into jail, which involves fingerprinting, photographing, and recording your personal information. Bail Hearing or Schedule: A judge will either set bail during a hearing or follow a pre-determined bail schedule based on the alleged offense. Paying Bail: If you have the full bail amount, you can pay it directly to the court. If you don't have the full amount, you can contact a bail bondsman. Posting Bond: The bail bondsman will require you to pay a percentage of the bail amount and may ask for collateral. Once the bond is posted, you'll be released from jail. Court Appearances: It's crucial to attend all scheduled court hearings. Failure to do so can result in forfeiting the bail or bond and further legal consequences, including a bench warrant for your arrest. Case Resolution: If you attend all court hearings, the bail or bond will be exonerated (returned or the obligation ended) at the end of your case. If a bond was used, the fee paid to the bond company is not returned. Factors Affecting Bail Amount: The nature and severity of the crime. Your prior criminal record. Your ties to the community (employment, family, etc.). Whether you are considered a flight risk, meaning you would try to flee and avoid your case. Alternatives to Bail: In some cases, a judge may release you on your own recognizance (OR), meaning you don't have to pay bail. This is typically granted to individuals with strong ties to the community, low-level charges, and a low risk of flight. This option may also include a promise to enroll into an Alcoholics Anonymous program, Narcotics Anonymous program, Domestic Violence course, or wear an electronic monitor that measures your blood alcohol level 24/7, just to name a few. When to Contact a Criminal Defense Attorney: It's essential to contact a criminal defense attorney as soon as possible after an arrest. An attorney can: Represent you at bail hearings. Negotiate for lower bail amounts. Explore alternatives to bail. Protect your rights throughout the legal process. Understanding bail and bond is crucial for navigating the criminal justice system. If you or a loved one has been arrested, don't hesitate to seek legal assistance. A knowledgeable criminal defense attorney can provide valuable guidance and support during this challenging time. If you or a loved one needs help understanding bail and bond or are facing criminal charges, contact Geronimo Gutierrez at Poseidon Defense APC today for a confidential consultation.

State Criminal Case Timelines - California Criminal Case Time Limits: Felonies & Misdemeanors Most states have different time limits depending on the severity of the crime: No time limit for serious offenses like murder and, in some states, certain sexual offenses. Longer periods (e.g., 5-10 years) for felonies such as fraud or violent crimes. Shorter limits (e.g., 1-3 years) for misdemeanors. Some exceptions can extend or toll the statute, such as the defendant being out of state or new evidence (e.g., DNA) emerging. In California, criminal case time limits are governed by the California Penal Code, primarily Penal Code §§ 825, 859b, 1381–1382, and the California Constitution (Article I, § 15), which guarantees a defendant's right to a speedy trial. Felony Cases 1. Filing of Charges If in custody: The prosecutor must file formal charges within 48 hours of arrest, excluding weekends and holidays (Penal Code § 825). If out of custody: There is no strict deadline, but charges must be filed within the statute of limitations (varies by offense). 2. Preliminary Hearing A felony defendant is entitled to a preliminary hearing within 10 court days of their arraignment (Penal Code § 859b). If the hearing is delayed beyond 60 calendar days, the case must be dismissed unless the defendant waives time. 3. Speedy Trial Time Limits After holding order (prelim hearing): The defendant must be arraigned on the information within 15 days (Penal Code § 1382). Trial must begin within: 60 calendar days from arraignment on the information. Defendant can waive time to allow more preparation. If a felony case is delayed beyond the time limit, it must be dismissed unless there is good cause. 4. Exceptions & Extensions Delays caused by the defense do not count toward time limits. Good cause delays (witness unavailability, mental competency hearings) may extend deadlines. The defendant’s absence (e.g., fugitive status) tolls the time limits. Misdemeanor Cases 1. Filing of Charges If in custody: Charges must be filed within 48 hours of arrest, excluding weekends and holidays (Penal Code § 825). If out of custody: Charges must generally be filed within the statute of limitations (typically one year for most misdemeanors). 2. Arraignment (First Court Appearance) If the defendant is in custody, arraignment must occur within 48 hours of arrest (Penal Code § 825). If out of custody, the arraignment date is set based on court availability. 3. Speedy Trial Time Limits If in custody: Trial must begin within 30 days of arraignment (Penal Code § 1382). If out of custody: Trial must begin within 45 days of arraignment. A defendant can waive time, which allows the trial to be scheduled later. 4. Exceptions & Extensions Delays caused by the defense do not count toward the speedy trial time limits. Prosecutorial delays may lead to case dismissal if they violate speedy trial rules. Court congestion is not always considered good cause for delay. 5. Dismissal for Violations If the prosecution fails to meet the trial deadline, the case must be dismissed unless the defendant waived time (Penal Code § 1382). Dismissals can be with or without prejudice, meaning the prosecution may be able to refile the case depending on circumstances.

Understanding California Self-Defense Laws: Protecting Your Rights with Poseidon Defense APC - Navigating the complexities of California's legal system can be daunting, especially when it involves self-defense. At Poseidon Defense APC, we understand the critical importance of knowing your rights and how to protect yourself within the boundaries of the law. This blog post aims to provide a clear and concise overview of California's self-defense laws, helping you understand when and how you can legally defend yourself. If you or a loved one faces charges related to self-defense, contact our experienced criminal defense attorneys for expert guidance. California law establishes that self-defense is an affirmative defense, requiring the defendant to prove that their actions were justified and that the force used was not excessive. The use of force must be necessary to prevent a threatened battery, and it cannot be used to retaliate for past actions. Evidence of prior acts of violence or threats by the plaintiff may be introduced to support a self-defense claim, but only if there is evidence of a specific overt act of hostility or threat of violence by the plaintiff that justifies the defendant's actions The California Supreme Court has held defendants who mistakenly believed that actual circumstances required their defensive act may argue they are guilty only of voluntary manslaughter, even if their reaction was distorted by mental illness. But defendants who contend they killed in self-defense because of a purely delusional perception of threat must make that claim at a sanity trial. Unreasonable self-defense and legal insanity are distinct theories, and must be adjudicated separately. The doctrine of imperfect self-defense is not available when the defendant’s belief in the need to defend himself or herself is delusional. This is because imperfect self-defense involves a misperception of objective circumstances, not a reaction produced by mental disturbance alone. Nor is it admissible at the guilt phase under California Penal Code Section 28(a). Key Concepts of California Self-Defense: California law recognizes the right to self-defense, but it's not absolute. It's crucial to understand the nuances to ensure your actions are legally justified. Here are the core principles: Reasonable Belief of Imminent Harm: Self-defense is justified when you reasonably believe you or another person are in imminent danger of suffering bodily harm. This belief must be objectively reasonable, meaning a reasonable person in the same situation would also believe they were in danger. California Penal Code Section 835a Proportional Force: The force used in self-defense must be proportional to the threat. You cannot use excessive force. For example, using deadly force to respond to a minor push may be considered excessive. California Penal Code Section 835a Duty to Retreat (Sometimes): California generally does not have a "stand your ground" law. However, there are some exceptions and nuances to this rule. Generally, one does not have a duty to retreat before using self-defense in their own home or workplace. However, outside of those locations, the particulars of each case greatly impact the courts decision. California Penal Code Section 198.5 Defense of Others: You can use self-defense to protect others if you reasonably believe they are in imminent danger. The same principles of proportionality and reasonable belief apply. California Penal Code Section 835a Defense of Property: While you can defend your property, the use of deadly force is generally not justified solely to protect property. The threat must involve a risk of serious bodily harm. California Penal Code Section 197 Understanding the "Castle Doctrine": California's "castle doctrine" provides that you have no duty to retreat when attacked in your home. This means you can use reasonable force, including deadly force, if you reasonably believe it's necessary to prevent imminent harm to yourself or others in your residence. California Penal Code Section 198.5 When Self-Defense Becomes a Legal Issue: Even if you acted in self-defense, you may face criminal charges if: The force used was deemed excessive. Your belief of imminent harm was not considered reasonable. The prosecution disputes your version of events. Understanding Restitution Hearings in California - After a criminal conviction in California, victims often seek restitution – court-ordered compensation for financial and emotional losses. At Poseidon Defense APC, we understand the complexities of restitution hearings. This blog post demystifies the process, focusing on how to effectively pursue restitution, particularly concerning emotional distress claims under California Penal Code 1202.4(f)(2). What is Restitution in California Criminal Cases? Restitution aims to "make victims whole" by requiring defendants to pay for losses stemming from their crimes. These losses encompass: Medical expenses Property damage Lost wages Counseling costs Emotional distress The California Restitution Hearing Process: Victim's Claim: Victims must meticulously document their losses with receipts, medical bills, wage statements, and therapy records. Defendant's Response: The defendant can challenge the claim, disputing the amount or causality of the losses. Court Determination: The judge reviews evidence and determines the restitution amount, considering the crime's severity and the defendant's ability to pay. Enforcement: The court can enforce the order through wage garnishment, liens, or other collection methods. Burden of Proof: The burden of proof for a restitution hearing under § 1202.4. Restitution; Amount; Hearing and court order; Financial disclosure is the preponderance of the evidence. This standard requires that the evidence presented must show that it is more likely than not that the claimed losses occurred as a result of the defendant's criminal conduct. § 1202.4. Restitution; Amount; Hearing and court order; Financial disclosure does not mandate any specific type of proof, but the trial court may consider various forms of evidence, including the probation report and statements from the victim, as prima facie evidence of loss People v. Gemelli, 161 Cal. App. 4th 1539, People v. Holmberg, 195 Cal. App. 4th 1310, People v. Shelly, 81 Cal. App. 5th 181. Once the prosecution or victim makes a prima facie showing of economic loss, the burden shifts to the defendant to disprove the amount of losses claimed. The defendant may present evidence to challenge the claimed losses, such as demonstrating that the amount exceeds the actual repair or replacement costs of damaged or stolen property People v. Gemelli, 161 Cal. App. 4th 1539, People v. Shelly, 81 Cal. App. 5th 181, People v. Millard, 175 Cal. App. 4th 7. The court's determination of restitution is reviewed for abuse of discretion, and the restitution order will not be overturned unless it is arbitrary or capricious People v. Gemelli, 161 Cal. App. 4th 1539, People v. Shelly, 81 Cal. App. 5th 181. Key Considerations and California Penal Code 1202.4(f)(2): Documentation is Paramount: Detailed records are crucial for successful restitution claims. Defendant's Financial Capacity: The court balances victim compensation with the defendant's ability to pay. California Penal Code 1202.4(f)(2): This critical section of the California Penal Code allows victims to seek restitution for noneconomic losses, including emotional distress. Specifically, it states: "Determination of the amount of restitution ordered pursuant to this subdivision shall not be affected by the indemnification or subrogation rights of a third party. Restitution ordered pursuant to this subdivision shall be ordered to be deposited in the Restitution Fund to the extent that the victim, as defined in subdivision (k), has received assistance from the California Victim Compensation Board pursuant to Chapter 5 (commencing with Section 13950) of Part 4 of Division 3 of Title 2 of the Government Code." This means that even if a victim receives assistance from other sources, such as insurance or the California Victim Compensation Board, it does not reduce the amount of restitution they are entitled to. Also, this section allows for recovery of emotional distress. This provision significantly expands victim rights, enabling recovery for intangible damages. Restitution and Insurance: The interplay between insurance payouts and restitution can be complex and requires careful legal navigation. Why Legal Representation is Essential: Attorneys protect defendants' rights, challenge inflated claims, and advocate for reasonable restitution amounts. Understanding Penal Code 1202.4(f)(2) and securing experienced legal counsel are crucial for achieving a just outcome. Contact Poseidon Defense APC today for expert guidance in your restitution case.

Can an officer order you out of the car during a traffic stop? - Can an officer order you out of the car during a traffic stop? Yes, police officers can order you out of your car during a traffic stop in California. This action is permissible under the Fourth Amendment as long as the traffic stop itself is lawful. The U.S. Supreme Court has held that officers may order the driver and passengers to exit the vehicle during a traffic stop to ensure officer safety, even without any specific suspicion of criminal activity. This principle was established in Pennsylvania v. Mimms and extended to passengers in Maryland v. Wilson People v. McDaniel, 12 Cal. 5th 97, People v. Evans, 200 Cal. App. 4th 735, People v. Lomax, 49 Cal. 4th 530. The courts have consistently recognized that traffic stops can be dangerous for officers, and allowing them to exercise control over the situation, including ordering occupants out of the vehicle, minimizes risks. The intrusion on personal liberty is considered minimal compared to the government’s interest in officer safety People v. McDaniel, 12 Cal. 5th 97, People v. Steele, 246 Cal. App. 4th 1110, People v. Castellon, 76 Cal. App. 4th 1369. Additionally, California courts have upheld this authority, emphasizing that the reasonableness of such actions is generally satisfied in traffic stops involving multiple occupants § 10.06 Detention Following Routine Traffic Stop.

Poseidon Defense A.P.C. is a California criminal defense law firm based in Fullerton, representing clients throughout Orange County, Los Angeles County, and surrounding Southern California courts. The firm focuses exclusively on state and federal criminal defense, handling both misdemeanor and felony cases. We represent individuals charged with violent crimes, assault and battery, criminal threats, domestic violence, drug offenses, DUI, gun charges, theft crimes, white collar allegations, probation violations, and post-conviction matters. We also handle complex cases involving digital evidence, protective orders, and federal investigations. Our approach is strategic and trial-ready. Every case is analyzed through constitutional, evidentiary, and procedural frameworks. We carefully review police reports, body-worn camera footage, forensic submissions, digital communications, and witness statements to identify weaknesses in the prosecution's case.

        History

        Established in 2025.

Although Poseidon Defense A.P.C. was founded in 2025, my experience in criminal defense spans years of successfully defending clients in state and federal courts. My passion for this work began with a desire to serve the public, which led me to law school, where I discovered my love for advocacy and public speaking. I honed my skills as a Deputy Public Defender and an associate attorney handling serious felony and misdemeanor cases. Now, at Poseidon Defense A.P.C., I use that experience to provide strategic, results-driven defense for clients throughout Southern California. I continuously train to refine my trial advocacy skills, ensuring I deliver the strongest defense possible. No matter the charge, I fight to protect my clients’ rights and future. If you’re facing criminal charges, you need an experienced advocate on your side—and I’m here to help.

Meet the Business Owner: Geronimo G.

I am passionate about criminal defense because I believe everyone deserves a strong advocate when facing the power of the justice system. With years of experience handling misdemeanor and felony cases in both state and federal courts, I’ve seen firsthand how a dedicated defense can change lives. At Poseidon Defense A.P.C., I take a strategic approach to every case, ensuring clients receive an outcome with professionalism and integrity. My background as a Deputy Public Defender and as an associate at a top defense firm has given me the tools to fight for my clients, no matter the charge. From pre-filing matters to serious felonies, I am committed to protecting my clients’ rights and helping them navigate a difficult system. Criminal defense isn’t just my job—it’s my mission.

Even though it was clearly not a case they could accept, Greg responded to my message right away and didn't just ignore it or give a generic reply. He was completely upfront and professional: he explained exactly why this type of matter falls under the prosecutor's jurisdiction/responsibility and isn't something private criminal defense attorneys handle. He didn't try to stretch it or take my money anyway -- instead, he gave me honest, practical guidance on what I should do next, who I might need to contact (like the DA's office or relevant authorities), and some realistic expectations. In a field where some lawyers might have tried to sign me up regardless, his straightforward integrity and willingness to help even when he couldn't represent me really impressed me. No BS, no pressure -- just solid, ethical advice from someone who clearly knows the system inside out. If you're dealing with any criminal or related legal question in Southern California, reach out to Greg Hill. You'll get real talk and respect, whether it's a case he can take or one he has to refer elsewhere. Highly recommend -- 5 stars for honesty and professionalism.

First, consider whether you need legal representation. Navigating the two separate branches involved--the justice system and the DMV--can be incredibly complex for anyone. Having a knowledgeable lawyer by your side simplifies and can streamline the process, ensuring you have support every step of the way. Additionally, professional representation can significantly improve the outcome of your case, which is unlikely to happen without skilled assistance. I chose the SoCal Law Network, and they provided professional, responsive representation that guided me through the entire process from start to finish. They minimized the burden on me and worked tirelessly to maximize the outcome in my best interests, which involved a complicated situation. I couldn't be happier with my decision to hire them and have nothing but positive things to say about their entire team. I've heard from others that not all lawyers are as responsive or client-focused. However, the SoCal Law Network exceeded my expectations. Their fees were fair and competitive, and their representation ultimately helped reduce the fees I paid to the courts. Hiring the SoCal Law Network was an excellent choice for me! They did not ask me to write any review - but I actually wanted to help other people going through the painful decision and choice picking a lawyer to just say, "This one is a good option".
