I contracted with Ryan to take down three trees, cut off a number of dead branches and treat my pine trees. Understandably he had to take down a section of my wooden privacy fence to access the backyard with his truck. They took down the trees without issue and cut off the dead branches as we agreed. However, they did not fully clean up all of the trees they had taken down. The next day my yard guy had to clean up the trees they took down and should have removed. In addition, they did not put my privacy fence back up. I contacted Ryan almost daily asking him to please put my fence back up since my pool was not visible and accessible and it was a liability issue. At first he promised that he would come and replace it but he did not and then I didn't hear from him for days. I finally told him I needed him to have my fence replaced immediately and he finally answered and said he would do it that day. I told him that I had lost confidence and since it had been a week and he still hadn't treated the pine trees I would like a refund since I had prepaid for that. He told me that he could not give me a refund on work he had done. I informed him that he had not treated my pine trees so I was not asking for a refund of work already done, he had not returned since he left late Wednesday night. He lied and told me that he "found" some of the product in his truck and he treated the trees Wednesday night. I told him that I knew he did not because I was watching him (I didn't tell him that I have cameras and video showing he never treated the trees). He continued to lie and try to tell me that he treated them. He finally agreed to come that day to replace my fence and refund me the money for services not rendered - no shock, he never showed up that day. I had two very nice men from my church replace my fence and I guess my step will be small claims court to get my money back for the treatment he never did. It was bad enough that he didn't follow through and completely clean up or replace my fence but there is zero excuse for lying about performing services he did not.
