Mr. Gambale took a case, threw everyone involved or so he thought was involved, up against a wall, hoping something would stick for his client. And nothing stuck! He was even reprimanded by the Judge for a tactic he executed in front of the jury. He was out of line and unprofessional. The Judge set forth a fine as well, having to pay another attorney an hour of his time for his stratagem. We were forced to hire and pay an attorney being our company is an LLC and we could not represent ourselves, not once but twice! The first time the case was withdrawn by Gambale and later refiled. Maybe because his client was in prison??? We lost time away from our daily lives and work as we had to meet with our attorney on several occasions, attend meetings with other parties named in the lawsuit and answer numerous emails and many phone calls. This is time we will never get back, for a non-productive citizen, who is a career criminal and his attorney! This was a frivolous lawsuit concerning our company. A civil lawsuit that we should have not been involved in! A civil lawsuit that Gambale LOST! It didn't take the jury long at all to deliberate. YOUR CLIENT'S ACTIONS CAUSED HIS OWN INJURIES! Sadly, we paid a settlement amount of $2000.00 just to get out of the lawsuit because it was cheaper than paying our attorney as the case went to trial. Justice? Is this truly Justice? Absolutely NOT! Shame on you Mr. Gambale! You thought you had a case. You saw $$$. You did not do your due diligence. For those of you who have been in a wreck and been injured, you know that within days after the filing of the accident report, you are swamped with about 20 pounds of mail... flyers and booklets from attorneys all wanting to grab their share of the insurance money due to you for your injuries blah blah blah... Then you begin to take notice of the TV ads that "mean business" and so on... What many people fail to notice is the firms that don't waste buku money on TV advertising, don't waste money chasing ambulances and don't waste their time taking cases for people who are just trying to win the lottery. Lacy Presnell has been in this business for 35 years, he knows what he's doing and he doesn't need to chase business down. He's been on both sides of injury cases and he gets his business from word of mouth advertising from people he's helped recover settlements for that help them get their bills paid and hopefully take care of their future needs. He's honest to the bone, even if it means having to tell a client news they don't want to hear (like me). Mr Presnell, drove out to my home, in Creedmoor, to meet me after I called him, more than once. He stopped along the way to get a glimpse of where the accident took place and take in the scene to see how it could have happened. More recently, he explained the consequences of a jury trial, how it could go (one way or the other depending on how jurors understand the law) and even if I were to win a large settlement, he was able to show me the math and probabilities in regards to the chances of collecting it. That was rather disturbing news, but I give him props for his honesty. To tell the truth, I don't know if I'll ever see a dime to cover my out of pocket medical costs or my pain/suffering, and that's what's disturbing about people in NC being under insured with no assets and no legal way in North Carolina to attach a settlement to a person's wages. It seems like the laws in NC protect those who cause injury instead of those who are truly injured. I try to live by the rule "Don't shoot the messenger" and in this case, it applies.
