I hired and paid Atty Jane Probst $40,745 from 01/15/19-04/20 for a non-divorce action custody…read morecase. This does not incl. the approx $500-$1000 a month for the GAL, the psych eval, the court reporters, the forensic acct, the PI and anyone else deemed necessary by Atty Jane Probst and, in some cases, referred by her personally. It's like I am living out "Divorce Inc." If you have not seen this documentary, I highly recommend you do so before you hire any atty. I feel that I was not made adequately aware by Atty Probst of just how much this was all potentially going to cost. In my initial interview upon hiring Atty Probst she indicated that "we need to get you some child support." Even though I was granted $1000 a month in temp support, my child's father went back to amend it. The judge gave very strict orders as to how questions should be phrased and asked, and Atty Probst was corrected numerous times by the Judge. The result of that expensive court visit was that my support was reduced to $469.00 which includes his portion of the health ins. The modification to reduce the child support hearing was brought up later by the Judge (under my new legal counsel) as an example of how instructions provided were not followed and it is important to do so in future hearings. I felt very embarrassed. A retired Atty agreed to review the bills from Atty Probsts office. Even though there were many affidavits drawn up in my case it was pointed out that I was very rarely charged the Paralegals rate (although I communicated with her on the affidavits because many of them needed corrections for spelling and date errors), the majority of the charges were at Atty Probst rate. I was billed for other clients and unrelated charges (Ex- on 12/15/19 there was a $300 charge for discussing issues related to Children's Court and on 03/16/20 there were charges for a marital settlement and an attorney that is not related to my case). It was pointed out that 90% of the emails are charged at $60 even if they are 1-line replies. There was a mediation for my case in 04/20. I felt that I was not adequately prepared by my legal counsel. Although there was a prior meeting with all the attys and the mediating Judge, I felt blindsided as to what the Judge was going to use as a means to direct mediation. While I felt uneasy during the mediation, what stuck with me was when we were waiting for our turn to speak. At that time, Atty Probst mentioned to me that a lot of her clients were having trouble paying with the onset of COVID. While I felt taken aback by this line of conversation, given the circumstances in which I was in, and being charged for that time, I replied that was prepared to handle my fees and I had money set aside for trial. My understanding of the amounts involved was, rather unfortunately, not in line with the amounts Atty Probst's office charged me for. Just for the month of April, my bill came to $8,305. Atty Probst put an atty from her team on my case (whose work I felt was sub-par, and I was charged for correcting most of it to my satisfaction and expectation). I understand that April was grueling (there was trail prep etc.), however I felt insulted and terminated her representation. In writing I offered to pay half of the $8,000. However, she countered for $6,000 and gave me 2 days to pay it. A month later, I spoke to her paralegal and offered $5,000. I found out today from my employer that my wages are being garnished (just 90 days before my rescheduled trial). I never even received notice about this to my home. Shame on me for trusting so blindly but when many things are being thrown at you you count on your attorney to be in your corner. Regardless of what Atty Probst rebuttal is to my review, I feel I was a good and steady paying client and until the last month I always made it a point to make Atty Probst bills a priority (even if my basic needs were ignored, or I went into massive debt). Don't blindly trust a referral as I did, do your research in advance and ask other attys about Atty Probst if you are considering her.
