I followed…read moreinstructions from the State Bar and filed a fee dispute regarding the remainder of my unearned retainer. Wouldn't you know that this firm declined to participate. I reviewed my invoices and they indicated a pattern where this firm made routine office tasks into billable legal events. Instead of billing for substantive legal progress. They billed you for every minor "ping," often spending more time documenting the charge than doing the work. For example: Charging a 0.1 (6 mins) or 0.2 (12 mins) fee for simply reading a one-sentence email or forwarding a date to a calendar. The Effect: A dozen of these "pings" a week adds up to hours of legal fees for zero actual legal strategy. They billed you to tell you there are no updates even if you did not ask for a case update. You were paying professional legal rates for clerical work that didn't advance your case. They used non-descriptive language to hide the fact that no substantive progress was being made. Example: Billing for "File Review" without any corresponding output (like a filed motion or a drafted letter). In my case they did not even bother to get the file from my previous attorney. This allows them to the bill whenever they needed to reach a certain dollar amount, regardless of whether the case required it. They front-loaded these minor charges to exhaust your funds before the real work began. By the time a major legal deadline arrived, your retainer is gone. Then they give the replenishment or withdraw ultimatum. They sent me an urgent demand for a "replenishment" of the retainer right before my hearing. They try to force a "pay-to-play" just to keep the case alive. They lock you in because you end up paying and paying making it nearly impossible to hire a new lawyer who would require a new retainer upfront. They try to "lock" folks in hoping they cannot afford to leave. I was fortunate other may not be. Can't afford to pay they drop you. Ask about the bill they bill you for asking then they drop you.
