I'm a delivery driver who received a written warning from Frenchman's Reserve over an alleged speeding incident involving 9 mph over the limit. I don't live in this community. I was there doing my job.
I understand that neighborhood safety matters. What I question is the way private communities handle these situations and whether the authority behind their warnings is being clearly explained to the people receiving them.
Florida Statutes §§ 316.006 and 720.305 address traffic jurisdiction and HOA enforcement powers. They do not give every private community unlimited authority to enforce traffic laws or impose whatever penalties it wants. The actual authority depends on the circumstances, the applicable law, and the community's governing documents.
Florida Statute § 318.18 addresses penalties for government traffic infractions. A private community's warning is not automatically the same thing as an official government traffic citation.
My question to Frenchman's Reserve is straightforward: What specific legal authority supports the warning sent to me, and what consequences can the association actually impose on a nonresident delivery driver?
I believe people deserve clear explanations rather than paperwork that leaves them wondering whether they're dealing with an official traffic citation or a private community's own enforcement process.
For anyone considering purchasing a home here, I recommend asking the HOA about its enforcement policies, how it handles complaints involving visitors and delivery drivers, and what rights residents have when disputes arise. Read the governing documents before committing to a property.
A beautiful neighborhood doesn't tell you everything about how its association operates. Transparency, fairness, and professionalism matter just as much as appearances.
Before buying into a community, make sure you understand its rules, its enforcement practices, and how it treats people who come there to work.
