Eric is the reason why I am able to be in my sons life again. My story is a case that was unfortunate, but seems to happen too often. Knowing how much I loved my son, my ex was taking him away and out of state in an attempt to get what she wanted. She had done this multiple times before in the past, in which I have given in. The latest ( and last) time was due to something as frivolous as wanting as smart phone. I knew that this wasn't right and couldn't let this continue anymore. After hearing all the horror stories from friends about how the California courts tend to favor the mother, I knew that it was going to be tough. I can't say enough good things about Eric... really I can't. I called him in Dec/Jan and told him of a family issue we are having and he spoke to me about how he could help and what the process may involve as well as giving me ballpark on cost. My husband and I were unsure about moving forward, but when we were, we called Eric a few weeks later. He remembered me and we scheduled a consultation. Right from the start, I was really impressed with Eric. He was honest, caring, and really communicative. Hi im writing this to help individuals in the process of finding an attorney. I know its hard. The first place many look is the internet. That's a bad move. From my experience i have learned that its best to actually go to a court room(yes u can do this)and watch an attorney work. That way u can see is he aggressive,is he/she quick,is he/she a pushover. You just get a better idea of what youre going to get. Which brings me to my review. Eric is a nice guy . when you meet him hes always smiling and seems to be a nice guy. And alot of these reviews mention how nice he is. But think about it do you really want a nice guy defending you. I found him to be a pushover in the courtroom and he wasnt quick. He let the opposing side run all over him. His technique was to not get the judge mad.....yet he allowed the other side to piss her off by asking for everything they wanted ....while we still remained quiet. Hes a new attorney and you can definately tell. I had a situation that allowed for what is called a hardship deduction. If your woman is going for child support and you have a hard situation ,like a new child or a major crisis such as unable to work,this hardship deduction can lower your child support. I told eric my situation and him being my attorney you would think he would point this out to me ,as somethin i could possibly use in court......ummmm no. I researched and found out about it. When i brought it to his attention he act like he never heard of it and said id most likely not get it,since courts rarely deviates from formula. Well guess what i got it . another thing is his lack of preparation. Court day is already a nervous day for most. The day of my hearing he comes with questions for me and the woman im going against in court. I was caught totally off guard by this. For the money i was paying it wouldve been nice if he practiced the questions with me or gave me a heads up a couple of days before the hearing so i could prepare or choose which questions were the most important. And speaking of money,even with his lack of experience you are still going to pay a pretty penny. You would do better getting a more experienced lawyer. I chose eric because he was young. I hope that this would make him more motivated, to work harder than someone who has been doin this for 30 years and just want your check. Im sorry to say,in my opinion eric was all about the money. Oh i almost forgot the best part. This is a child support case and he shows up to court without even having my w2 forms . At that point i honestly was embarrassed to have him as my lawyer. My exs lawyer pratically laughed at us. Who forgets a w2 form at a case regarding child support. Thats like forgetting to bring a car to a driving exam. This is my honest opinion. Sorry its so long. From our first meeting, when I came in nervous, scared, and completely ignorant of the process, he allayed all my fears. When I had questions about any aspect of the process (and I had a lot!), he was prompt (often answering immediately via text), courteous, and very clear. I did a lot of reading on the process of divorce (Nolo's Complete Guide to Divorce is a must read) and Eric filled in any gaps that I needed. I totally recommend Eric Mackey-Fitzgerald for several reasons. He held my mom in a time when she had no one to help or be there for her in any way possible. She was so totally stressed out, depressed and helpless.
