I was also billed for discovery that was never filed. She promised me on a Friday call that my case would be her first priority Monday morning. Instead, I got an invoice for even more money and then total silence -- nothing further was done on my case. I had to hire new counsel just to keep things moving, paying again for discovery and other work, and dealing with delays because the firm was slow to release my file. Unfortunately, he was the opposite of helpful, made so many mistakes, and added another layer of stress and confusion to the whole process. After everything we have experienced, I genuinely wish we had never hired him. From the beginning, Duncan gave us advice that could have negatively affected our case, which we only caught after doing our own research. Communication was also extremely difficult. He regularly did not respond to emails, did not answer his phone, and became upset when we called repeatedly about urgent questions after not hearing back for days. He did not keep up with the docket or appear to know what was happening in our case. We had to monitor everything ourselves and update him on the few occasions we actually spoke. He even completely forgot about our final hearing until just hours before. We prepared a detailed packet of evidence, and thankfully our tenant did not appear in court because he was not prepared and did not submit any exhibits to defend us. We paid him almost $1,900 total for a notice to vacate and a total of about five minutes in front of a judge on our behalf. The work he was supposed to do behind the scenes was either done incorrectly or not done at all. Every call and hearing felt rushed, and we received little to no guidance before or after court. Even afterwards we are dealing with issues with the final judgment not being filed correctly and including putting incorrect property owner information on the document, and he expected us to handle it ourselves. At this point, I genuinely cannot think of a single thing he did for us that we had not already done ourselves or could not have easily done without him. While we appreciated his transparent flat-rate pricing, we do not feel we received the guidance, communication, or preparation we paid for. We repeatedly had to do our own research, monitor our own case, and worry about whether our attorney was doing his job. We genuinely regret hiring Duncan and would not recommend him to anyone.
