To all the new, existing, and past customers who have been fooled by this company, please join me in creating a class action lawsuit against this company.
Like so many before and dating back so far, I received a call from a man named Jon Cummins who said he advertise on a local 11 News channel, which gave me the impression that this is a legitimate company. He even lead me to the news website, showed me where to click to get to demos of all the advertisements, to make it appear legit. All seems great so I, of course, signed up! The first red flag should've been on the contract, when I saw Sinclair was where I received Jon's email from but the contract was with DataSphere. Nevertheless, thinking it's because they contract their services through DataSphere, to do the technical stuffs, I brushed it aside.
Before talking to Jon, I had done my own advertisements via Google Ads, Facebook Ads, and Yelp Ads, which can add up quickly, so when I heard from Jon that their service provided all these services for a mere, introductory offer of around $400 a month, I thought it was a great deal. Unbeknownst to me, what they're providing is fake (that's right!) fake visitors! They're mistake is dealing with someone who's also very technical and was wanting to offset the work to them, for the price they were offering. For the 1st month, I immediately saw a downturn in visitors as well as customers to my physical store and reached out to them to inquire. With how many years they've been doing this, they obviously knew all the right ways to give you the runaround. At first, I thought they made a mistake somewhere because I searched and could easily find my Google ads but not theirs. I repeatedly sent emails to DataSphere's support team, and even to Jon Cummins, trying to get them to fix it. They gave me one excuse after another so I stopped bothering to verifying it that way but instead, using my technical expertise as a web developer, asked them to prove where I'm getting all these so called Actions from but am not seeing any visitors to my site. I asked for concrete evidence because anyone can easily manipulate their dashboard so they offered to direct all ad traffic to my site instead, which I thought was very sincere and would be great. All I cared about at the stage was that I was getting what I paid for. For the first 2 weeks, I indeed saw a huge increase in traffic to my site, which is great because my Google Ads were not garnering as many visitors, even when I was offering a 50% off, grand opening special! I thought they must be doing something right and better. However, how come I wasn't getting as many new customers as before? I started to wonder if these visitors are really visitors but it wasn't easy to tell because I was getting traffic from many different sources on the web. To work around that, I created a specific landing page for DS and had them redirect all DataSphere ad clicks to that page instead. That page requires the user to click on a service they're interested in, so I know they're real. After the 1st week, I had maybe 70 visitors but those, about 2 actually clicked on anything. This gave me the impression that these were not real visitors so I questioned the company. I told and asked them, why is it that my actual site, where I received visitors from the web, shows over 99% activity while users, supposedly coming from them and landing on my DS page, showed maybe 1% activity? They visited my landing page and their excuse was that the landing page didn't look like the main page. Fine, again, they're messing with someone with the technical expertise so I created an exact replica of my actual site, so that DS has their own. Any visitor who lands on the DS page will remain in the DS area, while perusing my site. After 1 week, with enough evidence, I again came back to them but this time they can no longer come up with an excuse because I have data from Google Analytics to back me up. As of this writing, my data shows 50 landings on the DS page and 1 landing other pages, in other words, a real user who's perusing the site. Of my 28 landings on my main site, I get 28 who visited my services page and varying amounts on the other pages. In other words, all of my actual site landings are real users while 1 out of 50 from DS is real.
I know better than to cancel my contract because they will charge me 40% of the remainder and this is where they can get away with it. I'm holding onto my contract as I build evidence against them and I'm not afraid to let them know about it either. I repeatedly told them I was building a case against them and expect to get every penny back. I will be reporting them to the BBB as well as the FTC because this is clearly a case of false, if not fraudulent advertisement.
