I'm very disappointed with my experience with this firm…read more I initially started my trademark application on my own and worked through multiple USPTO refusals until there was only one issue remaining. At that point I was advised that the response would require complex legal wording and that attempting it myself would likely lead to another refusal. Based on that advice, I hired this firm and paid over $5,000 for them to prepare and file the response. Before proceeding, I was told by one of their attorneys that she was "99.9% confident" the issue would be resolved and that the trademark would move forward. Unfortunately, after the response was filed the trademark was refused again. During a follow-up call with the head attorney, I was told that the examiner had withdrawn the original refusal and issued a completely different refusal based on descriptiveness. I was then told that the chances of success were now low and that continuing the process would require multiple additional responses and several thousand dollars more in legal fees, or potentially starting the application over entirely. What made this particularly frustrating is that much of the evidence they are now recommending to prove "acquired distinctiveness" had already been shared with them earlier. My product has been on the market for over three years with more than 50,000 units sold, multiple videos with millions of views, and significant public recognition linking the product name to my brand. After already investing more than $5,000 and being told the chances were now low and that significantly more money would be required to continue, the situation felt very discouraging. To their credit, the attorneys were polite during our conversations and did acknowledge my frustration. However, the overall experience left me feeling that expectations were set far too high at the beginning and that the process ultimately became far more expensive and uncertain than initially presented. Because of this experience, I will likely be seeking another trademark attorney to continue the process.
