He failed to act with reasonable diligence. He failed to reasonably consult with the client about the means by which the client's objectives are to be accomplished. He failed to explain the matter to the extent reasonably necessary to permit the client to make informed decisions. He failed to inform the client that, as a result of his violations of professional conduct that he, as executor, would nullify the last wishes in the very same will that he prepared and witnessed. As a result of his own negligence and lack of due diligence, Frank Anthony Brancato have made nullifications of last wishes contrary to the intention of the will.
